Our Privacy Policy applies to information we collect when you use pushpay.com, its mobile payment application for use on iOS and Android smart phones (the “Application”), and information disclosed to Pushpay (defined below) directly (collectively, the “Website”). Our Privacy Policy is designed to assist you (the “User” or “you”) in understanding how Pushpay Inc. and its affiliates (“Pushpay,” “Company,” “we,” or “us”) collects and uses the personal information you provide to us and to assist you in making informed decisions when using the Website and our services.
Pushpay is committed to ensuring the privacy of all Users information.
CONSENT
By using the Website, you consent to the collection and use of information by us as set forth in this Privacy Policy. If we decide to change our Privacy Policy, we will post those changes on this page so that you will always be aware of what information we collect, how we use it, and under what limited circumstances, if ever, we disclose it. Continued access or use of the Website shall constitute your express acceptance of any modifications to this Privacy Policy.
This Privacy Policy does not cover information that you submit on other websites, even if we communicate with you on those sites. For example, if you post something on Facebook, Twitter, or YouTube, that information is governed by the privacy policies on those websites, and is not governed by this Privacy Policy.
PERSONAL INFORMATION
In order to use the mobile payment services offered by Pushpay through the Application (the “Services”), all Users will need to submit certain personal information (“Personal Information”) about themselves (as prompted by the Website and/or Application), name, address, telephone number, or e-mail address. Personal Information also includes information about an individual’s activities, such as information about his or her activity on our Services, and demographic information, such as date of birth, gender, geographic area, and preferences (such as the name of the church they attend, church location, and attendance patterns) when any of this information is linked to Personal Information that identifies that individual.
Personal Information does not include “aggregate” or other non-personally identifiable information. Aggregate information is information that we collect about a group or category of products, services, or users that is not personally identifiable or from which individual identities are removed. We may use and disclose aggregate information, and other non-personally identifiable information, for various purposes.
We engage third parties, such as Google’s Analytics to provide analytics about the use of the Website. These entities may use cookies, web beacons, pixels, embedded scripts, and other technologies to automatically collect information about your use of the Website, such as your IP address, web browser, pages viewed, time spent on pages, links clicked, and conversion information.
LOCATION-BASED SERVICES
The Application collects and records each User’s location, provided that Users have given their consent and their device settings allow it. This location information is used to identify Merchants in a User’s proximity and to pinpoint the location of a transaction for security purposes (“Location-based Services”). If you choose to disable any Location-based Services on your device and/or opt out of any Location-based Services through the Application’s Settings menu, you will not be able to utilize certain features of the Services. By enabling Location-based Services on your device, you agree and acknowledge that (1) device data we collect from you is directly relevant to your use of the Services, (2) we may provide Location-based Services related to and based on your then-current location, and (3) we may use any such information collected in connection with the provision of Location-based Services in connection with its provision of the Services and as otherwise provided for in this Privacy Policy.
INTEGRATED SERVICES
You may be given the option to access or register for the Services through the use of your user name and passwords for certain services provided by third parties (each an “Integrated Service”), such as through the use of your Twitter credentials through Sign in with Twitter. By doing this, you authorize us to access and store the credentials you provide and your name. You should check your privacy settings on the Integrated Service to understand and change the information sent to us through that Integrated Service. Please review each Integrated Service’s terms of use and privacy policies carefully before using their services and connecting to our Services.
INTERACTIVE FEATURES
The Services may contain interactive functionality that allows you to engage with other users on the Services, post comments to forums, to make prayer requests, to upload photographs and other content (the “User Materials”), participate in surveys, and otherwise to interact with the Services and with other users. If you use any interactive functionality on the Services that request or permit you to provide us with Personal Information (including, for example, any services that allow you to post User Materials on any of our Services), we collect the Personal Information that you provide to us in the course of using these interactive features.
CONTESTS AND SWEEPSTAKES
We or our advertisers and other business partners may conduct or sponsor special contests, sweepstakes, and other promotions that users may enter or otherwise participate in on our Services. Certain of these promotions may be co-branded with one of our advertisers or other business partners. In these instances, the collection of your Personal Information may occur directly by the third-party partner on its website or other online service and may be shared with us. The promotion will state the privacy policy or policies governing the collection of such Personal Information.
EMAIL INFORMATION
If you choose to correspond with us through email, we may retain the content of your email messages together with your email address and our responses.
PASSIVE INFORMATION COLLECTION
When you visit our Website, some information is collected automatically. For example, we may automatically collect your browser’s Internet Protocol (IP) address, your browser type, the nature of the device from which you are visiting the Website (e.g., a personal computer or a mobile device), the identifier for any handheld or mobile device that you may be using, the Web site that you visited immediately prior to accessing our Website, the actions you take on our Services, and the content, features, and activities that you access and participate in on our Services. We also may collect information regarding your interaction with e-mail messages, such as whether you opened, clicked on, or forwarded a message.
We may collect this information passively using technologies such as standard server logs, cookies, and clear GIFs. We use passively-collected information to administer, operate, and improve the Website and our other services and systems.
Please be aware that in the course of your use of the Service, websites or other services provided by third parties (“Third-Party Services”), including, for example, Google Analytics, may set cookies on your hard drive or use other means of passively collecting information about your use of the Service, Third-Party Services or other services or content. To do this, they may use first-party cookies (which are set by the same domain your browser is receiving data from) or third-party cookies (which are set by a different domain). We also may make non-personally identifiable information available to Third-Party Services, and these Third-Party Services may collect such information, to assist such parties in understanding our users’ activities and usage patterns on the Services. We do not have access to, or control over, the actions of Third-Party Services. Each provider of Third-Party Services uses information that it collects in accordance with its own privacy and security policies.
INFORMATION FROM OTHER SOURCES
We may receive information about you, including Personal Information, from third parties, and may combine this information with other Personal Information we maintain about you. If we do so, this Policy governs any combined information that we maintain in personally identifiable format.
USE OF INFORMATION AND DATA
The information that Users provide will be primarily used in connection with the Services, to communicate with Users in relation to the Services or to cooperate with any government, industry or regulatory authorities. We may also disclose your information when we believe in good faith that disclosure is necessary to protect our rights, your safety or the safety of others, investigate fraud, or respond to a government request, in connection with the collection of amounts you may owe us, and/or to law enforcement authorities whenever we deem it appropriate or necessary. Please note we may not provide you with notice prior to disclosure in such cases. If we are involved in a merger, acquisition, or sale of all or a portion of our assets, you will be notified via email and/or prominent notice on our Website of any change in ownership or uses of your personal information, as well as any choices you may have regarding your Personal Information.
Occasionally, we may use the information we collect to notify you about important changes to the Website, new services and any information we think you will find valuable. Pushpay reserves the right to use data (on an anonymous basis) in relation to Users’ use of the Services for marketing and accounting purposes. DISCLOSURE OF INFORMATION
Unless expressly authorized to do so by the applicable User or under this Privacy Policy, Pushpay will not disclose any User’s personal information to any third party except where disclosure relates to the purposes for which the information was collected.
ACCESS TO AND UPDATES OF INFORMATION
Users may request at any time to see the personal information that Pushpay holds on its behalf or to correct or update any personal information (to the extent that Users are unable to do so through the Website or Application). Please email Pushpay at helpme@pushpay.com.
STORAGE OF INFORMATION AND EXPORT COMPLIANCE
Pushpay will securely store all Users’ personal information, which may (for the avoidance of doubt) be transferred outside of the United States.
User access to this Website is governed by all applicable federal, state and local laws. All information available on this Website is subject to U.S. export control laws and may also be subject to the laws of the country where you reside.
SECURITY
Pushpay is committed to data security. Pushpay uses a variety of technologies and procedures to help protect personal information from unauthorized access, use or disclosure. For example, Pushpay stores the data in computer servers with limited access that are located in controlled facilities secured by the latest in surveillance and security technology. When Pushpay transmits sensitive information (such as a credit card numbers), Pushpay protects it through the use of encryption, such as the Secure Socket Layer (SSL) protocol. Pushpay is a level 1 certified PCI-DSS compliant provider. PCI Data Security Standards are endorsed by Visa, MasterCard, American Express and all other leading card brands.
RETENTION
Pushpay will hold Users’ personal information both before and after the cancellation of each User’s account, but only for as long as Pushpay is lawfully entitled to do so.
TECHNOLOGY PARTNERS
Pushpay partners with payment gateways to process credit card payments and those gateways maintain their own privacy policies.
CHILDREN
Our Website is intended for a general audience and not directed to children under 13 years of age. We do not intend to collect personal information as defined by the U.S. Children’s Privacy Protection Act (“COPPA”) (“Children’s Personal Information”) in a manner that is not permitted by COPPA. If you are a parent or guardian and believe we have collected Children’s Personal Information in a manner not permitted by COPPA, please contact us by sending a letter to the email address listed below (Attention: Legal) and we will remove such data to the extent required by COPPA.
Parents may want to consider commercially available parental control protections to limit what minors can access online and/or monitor their minor children’s online activities. Examples include: www.netnanny.com; www.webwatcher.com and www.sentrypc.com. We do not endorse these or other services and are not responsible for them.
